DMCA / Copyright Policy

Hypersmarty LLC ("Hypersmarty," "we," "us") operates OptimaClip (the "Service") and respects the intellectual property rights of others. This policy explains how copyright owners can report infringing material and how account holders can respond, consistent with the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Customers choose and are responsible for what they submit

OptimaClip is a tool: customers paste a video link (YouTube, Twitch, Kick, or any direct video file URL) or upload a file, and OptimaClip transcribes it and generates clips. We do not select, curate, review, or endorse source material before it's processed, and we don't monitor customer accounts for infringing content before it's reported to us.

Every customer is required to confirm, at the point they submit a video or link, that they own it or are otherwise authorized to use it and have it processed and clipped by the Service — see the confirmation checkbox on the New Clip Job form and Section 4 of our Terms of Service. The customer who submits a video or link — not Hypersmarty — is solely responsible for having the rights to do so and for any resulting infringement.

2. Filing a takedown notice

If you believe material available through OptimaClip infringes your copyright, send a written notice to our designated agent (contact below) that includes:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it (e.g. the OptimaClip clip URL/ID, or the account and source link involved);
  • Your contact information — address, telephone number, and email address;
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

3. What happens after a valid notice

On receipt of a notice that substantially complies with the requirements above, we will remove or disable access to the identified material, notify the account holder who submitted it, and provide them a copy of the notice. Repeat or clearly abusive submitters are subject to Section 6 below.

4. Counter-notification

If material you submitted was removed or disabled and you believe this was a mistake or misidentification, you may send a counter-notice to the same address including:

  • Your physical or electronic signature;
  • Identification of the material removed and its location before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  • Your name, address, and telephone number; and
  • A statement consenting to the jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which Hypersmarty may be found), and that you will accept service of process from the person who filed the original notice.

Unless the original complainant files a court action seeking to restrain you within 10 business days of receiving a copy of your counter-notice, we may restore the material within 10–14 business days, as the DMCA provides.

5. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing (or that its removal was a mistake) can be liable for damages, including costs and attorneys' fees.

6. Repeat infringer policy

Accounts that are the subject of repeated valid takedown notices will have the affected functionality restricted, and may be suspended or terminated, at our discretion, consistent with 17 U.S.C. § 512(i).

7. Changes

We may update this policy from time to time; material changes are reflected by an updated "Last updated" date above.
